<p>Nếu Bên B đóng tiền muộn hơn hạn đóng tiền 3 ngày thì bên A có quyền đơn phương chấm dứt hợp đồng và không phải trả lại tiền đặt cọc</p>



<p><em>If Party B pay late 03 (three) days, Party A can unilaterally terminate the contract and do not have to pay back deposit to Party B.</em></p>



<p><strong><u>ĐIỀU 5: TRÁCH NHIỆM CỦA BÊN CHO THUÊ (BÊN A)</u></strong></p>



<p><strong><em><u>(ARTICLE 5: LESSOR&#8217;S (PARTY A&#8217;S) RESPONSIBILITIES)</u></em></strong></p>



<p>1. Đảm bảo và cam kết rằng BÊN A có đủ quyền hạn được cho thuê phòng trong nhà, BÊN A đảm bảo rằng tòa nhà này không bị tranh chấp.</p>



<p><em>(Assuring and committing that Party A has the right to lease/rent the room in this building; that this building is not in the state of dispute).</em></p>



<p>2. Bàn giao cho Bên B toàn bộ diện tích cho thuê với mọi trang thiết bị, tiện nghi của hạ tầng kỹ thuật như đã quy định tại Điều 1, vào ngày có hiệu lực của hợp đồng này:</p>



<p><em>(Handing over to Party B the rented area and all of its equipments, facilities of the technical infrastructure as stipulated in the Article 1, on the validity date of the contract).</em></p>



<p>3. Đảm bảo cho Bên B quyền sử dụng hợp pháp, trọn vẹn, riêng biệt phần diện tích cho thuê.</p>



<p><em>(Ensuring Party B the right to use legally, fully ad separately the said rented area).</em></p>



<p>4. Sửa chữa kịp thời những hư hỏng về cấu trúc xây dựng tòa nhà gây ra, đo độ tuổi của tòa nhà, hoặc do thiên tai, và chịu mọi chi phí cho việc sửa chữa này.</p>



<p><em>(Timely repairing any damages of the building structure caused by its longevity or by natural disasters and bearing all expenses for these repairs).</em></p>



<p>5. Bồi thường cho Bên B mọi thiệt hại về vật chất và sức khỏe gây ra do sự chậm trễ sửa chữa trong trường hợp xảy ra sự hư sụp tòa nhà.</p>



<p><em>(Compensating Party B for all damages of materials and health caused by the delay of repair in case the collapse of the building happens).</em></p>



<p>6. Hướng dẫn Bên B chấp hành nghiêm túc và đầy đủ mọi luật lệ quy định pháp lý do Chính Phủ nước CHXHCN Việt Nam ban hành.</p>



<p><em>(Guiding Party B in implementing fully and strictly all legal regulations stipulated by the Government of the S. R of Vietnam)</em></p>



<p>7. Bên A có quyền đơn phương chấp dứt hợp đồng nếu:</p>



<p>&#8211; Bên B gây mất trật tự lớn, ảnh hưởng đến hàng xóm và những người thuê nhà khác</p>



<p>&#8211; Bên B tiêu thụ sử dụng tàng trữ chất gây nghiện bị cấm trong luật pháp Việt Nam</p>



<p>&#8211; Bên B cố tình hủy hoại cơ sở vật chất và đồ đạc trong nhà.</p>



<p><em>Party A can unilaterally terminate the contract in the event of:</em></p>



<p><em>&#8211; Party B disorders the public rules, that might affect neighbors and other tenants</em></p>



<p><em>&#8211; Party B consumes/utilizes/trades illegal drugs (following Vietnamese regulation) during the tenancy (whetherthe inside or outside the house)</em></p>



<p>&#8211; Party B intentionally destroys facilities of the house</p>



<p><strong><u>ĐIỀU 6: TRÁCH NHIỆM CỦA BÊN THUÊ (BÊN B)</u></strong></p>



<p><strong><em><u>(ARTICLE 6 : LESSEE&#8217;S (PARTY B’S) RESPONSIBILITER</u></em></strong></p>



<p>1. Trả tiền đặt cọc, tiền thuê/cho thuê và các chi phí khác đầy đủ và đúng thời hạn.</p>



<p><em>(Paying timely and fully the amount of security deposit, the rental fee and other costs/fees).</em></p>



<p>2. Sử dụng diện tích được cho thuê thuê theo đúng mục đích đã đăng ký và cho phép.</p>



<p><em>( Using the said rented area in compliance with the above registered and authorized purpose).</em></p>



<p>3. Nếu cần sửa chữa và cải tạo diện tích được thuê do nhu cầu sử dụng của mình, Bên B phải được sự đồng ý của Bên A bằng văn bản, và phải tuân thủ các quy định về xây dựng cơ bản, Imọi chi phí xây dựng, sửa chữa, cải tạo do Bên B chịu. Khi hợp đồng này chấm dứt hoặc khi bên 5 bàn giao lại cho Bên A diện tích được thuê cho Bên A, phòng phải được giữ nguyên trạng Anh bàn giao và Bên B không được đòi bồi thường về những chi phí xây dựng, cải tạo mới này.</p>



<p><em>(If Party B needs to repair or to renovate the rented area by its use requirements, Party B must get Party A&#8217;s agreement in writing and must comply with the regulations on construction. All expenses of repairing/renovating will be born by Party B. When this present contract terminates or when Party B transfers the rented area to Party A, the rented office must be kept as per the current status upon delivery and Party B shall not claim for any/all compensation for such new repair/renovation).</em></p>



<p>4. Bồi thường bất kỳ/mọi hư hỏng phần được thuê và/hoặc bất kỳ/mọi mất mát về các trang thiết bị và đồ đạc cũng như các tác hại gây ra cho người khác do việc sử dụng của Bên B.</p>



<p><em>(Compensating for any/all damages to the rented place and/or any/all losses of facilities and equipments and furniture as well as bad consequences caused to the others by Party B&#8217;s use).</em></p>



<p>5. Thông báo kịp thời cho Bên A bất kỳ hư hỏng phần được thuê của tòa nhà do tuổi thọ tòa nhà hoặc do thiên tai gây ra.</p>



<p><em>(Timely informing Party A of all/any damages to the rented area caused by its longevity or by natural disasters).</em></p>



<p>6. Tuân thủ nghiêm túc mọi luật lệ, pháp luật quy định do nhà nước CHXHCNVN ban hành.</p>



<p><em>(Strictly obeying all laws and regulations promulgated by the State of S.R VIETNAM).</em></p>



<p>Chấp hành mọi quy định về bảo vệ vệ sinh môi trường, an ninh trật tự công cộng, phòng cháy chữa cháy.</p>



<p><em>(Abiding all regulations and rules on the environmental hygiene, public order and security, fire fighting and prevention, etc.)</em></p>



<p>Chịu hoàn toàn trách nhiệm về mọi hoạt động của mình trước pháp luật VN hiện hành.</p>



<p><em>(Taking full responsibilities for the activities of itself to the current Vietnamese Laws).</em></p>



<p>7. Không được cho thuê lại hoặc chuyển nhượng một phần hoặc toàn bộ diện tích được thuê cho cá nhân/công ty/tổ chức khác.</p>



<p><em>(Not sub-leasing or transferring partly or wholly the rented area to another person/ company/ entity).</em></p>



<p>8. Thanh toán dứt điểm mọi chi phí sử dụng điện, điện thoại, fax và các chi phí khác (nếu có) trước khi thanh lý hợp đồng.</p>



<p><em>(Paying up all expenses of electricity, telephone, fax fax and other charges, if any, before making the contract liquidation).</em></p>



<p>9. Chịu trách nhiệm về bất kỳ/toàn bộ sự bảo dưỡng và mất mát các trang thiết bị, nội thất trong phòng, tài sản cá nhân của bên B.</p>



<p><em>(Taking responsibilities for any/all maintenance/s] and loss(es) of facilities, furniture inside the room, Party B&#8217;s personal properties).</em></p>



<p>10. Đồng ý với các điều khoản đã ghi trong phụ lục hợp đồng</p>



<p><em>(Agree with all the terms specified in the annex of this contract).</em></p>



<p>11. Bên B không được tiết lộ về giá cho thuê phí dịch vụ khác thời hạn thanh toán cho bên thứ 3 nếu như chưa được sự cho phép bằng văn bản của bên A.</p>



<p><em>(Party B is not disclose the rent feel other services fee and payment term to third party without Party A&#8217;s agreement in writing)</em></p>



<p><strong><u>ĐIỀU 7: CHẤM DỨT HỢP ĐỒNG</u></strong></p>

<p>c) Theo quy hoạch chung của Thành phố Hà Nội.</p>

<p>d) Bên B không thể tiếp tục tại Thành phố Hà Nội theo quy định của cấp thẩm quyền.</p>

<p>Nếu Bên A chấm dứt hợp đồng này trước thời hạn thì phải xác nhận trước cho Bên B ít nhất 15 ngày, Bên A phải hoàn trả lại cho Bên B tiền đặt cọc, tiền thuê/cho thuê còn thừa của Bên B (nếu có).</p>



<p>(In the event of early termination from Party A, Party A will need to confirm Party B at least 15 days prior to its expiration and Party A will refund Party. B the security deposit/remaining amount of rental fee (if any).</p>



<p>Bên B trả phòng phải thông báo trước cho bên A ít nhất 30 ngày qua email (hieudt1691@gmail.com) hoặc nhắn tin cho quản lý nhà. Trả phòng trước khi kết thúc hợp đồng bên B sẽ không nhận được tiền đặt cọc, trả phòng đúng khi kết thúc hợp đồng và sau khi kết thúc hợp đồng, bên A sẽ trả lại tiền đặt cọc nếu bên B đã báo trước ngày ra 30 ngày bằng văn bản. <p>This is just a simple explanation of the type of rentals that are available in Vietnam. &nbsp;Terminologies are not always the same everywhere so this will explain what type of housing to search for when you are home hunting. &nbsp;If you need parking, make sure you also make that clear along with your budget, location, type of home and other requirements.</p>



<h5 class="wp-block-heading"><strong>Furnished &amp; Unfurnished Apartments</strong></h5>



<p>The term condominiums is not used in Vietnam, therefore apartments can be a flat with no amenities are it can be in a larger building where amenities such as swimming pool, gym, parking, staff on property and security are included. It is important to let your agent know what you are looking for. Whether the place is furnished or unfurnished has no bearing on what would be included on the premises. Keep in mind that with the heat in Hanoi, assure that each room has an Air conditioning 2 way unit. &nbsp;Some landlords can be persuaded to include dehumidifiers or air purifiers, but in general, you will need to get those yourself.</p>



<p>Furnished Apartments&nbsp;usually includes living room set, dining room set, cabinets and closets &amp; beds. &nbsp;If you have furniture that you wish to bring in but not quite enough to fill a whole home, &nbsp;speak to your Vietlong Housing Agent to see if they can negotiate on your behalf with the Landlord. Often, you may be surprised at the outcome when a compromise can be reached</p>



<p>Unfurnished Apartments&nbsp;will come with the basics appliances in the kitchen – Fridge, Microwave and stove. &nbsp;Remember to open the appliances when you are viewing a home. Surprisingly, Oven &amp; dishwashers are NOT a common appliance in the home and again, speak to your Vietlong Housing Agent if those are on your priority list. Often the landlord will compromise with a larger deposit or maybe more monthly paid out upfront.</p>



<h5 class="wp-block-heading"><strong>Serviced Apartments/houses</strong></h5>



<p>These types are common for short term business purposes but many families find this style of living is the most Hassle free as well and allows them to be in a smaller community style of living. With more options available in Vietnam, serviced houses are available and also duplex apartments. &nbsp;The following is commonly but not necessarily always included in Serviced apartments/houses (please note some services may involve an extra fee)</p>



<ul class="wp-block-list"><li>BREAKFAST</li><li>SPORTS FACILITIES (GYM, SWIMMING POOL &amp; TENNIS COURTS)</li><li>MEETING ROOMS</li><li>PARTY ROOMS</li><li>MAID SERVICE (CAN BE UPTO 3 TIMES A WEEK)</li></ul>



<h5 class="wp-block-heading"><strong>Houses</strong></h5>



<p>Houses&nbsp;commonly used to classify single dwelling homes (can be duplex or townhomes style) where the&nbsp;property area is smaller. &nbsp;For example, a smaller yard or often none at all. &nbsp;The homes are also located much closer to the neighbouring homes, is less than 200 sq. m in land area and often does not have a view.</p>



<h5 class="wp-block-heading"><strong>Villas</strong></h5>



<p>Villas&nbsp;is classified as free standing single dwelling homes where the surroundings is less crowded. &nbsp;&nbsp;More open space between the neighbouring homes and land size is commonly over 200 sq.m. in area. Three common areas in Hanoi that have Villas are in Tay Ho, Ciputra and Vinhomes in Long Bien. Gated community areas such as Ciputra and Riverside Vinhomes has enforced security. ( TIP: This means moving in day with truck requires permits for the gate and apartment elevators. &nbsp;Vietlong Housing agents will assist with these requirements and assure that your chosen moving company is in contact with the right management personnel)</p>

<p>It is alway a difficult choice to decide if you should bring your furry loved ones with you on your adventure. &nbsp;The following will highlight some of the rules for bringing in your pets to Vietnam and some options on how to bring them over. We do not endorse any of the companies mentioned below but it is merely for information purposes. Please remember there are alway updated rules for every country so make sure you are well acquainted with the rules for Vietnam and your own leaving country. &nbsp;&nbsp;If you are not sure, Please also contact the Vietnamese Embassy in your country as they will also be able to provide you with the most updated information.</p>



<p>There are a few ways you can bring your pets into Vietnam. You need to decide what is the best amongst them. &nbsp;Please also take into account the time of the year you are moving your dog. Many airlines do not allow dogs to be on the flight if the outside temperature is too hot.</p>



<ol class="wp-block-list"><li>RESERVE FOR A SPACE FOR THEM AHEAD OF TIME IN CARGO. PLEASE MAKE SURE THAT YOU HAVE THE RIGHT CARGO BOX FOR YOUR PETS. &nbsp;ALL AIRLINES WILL HAVE A LINK TO PROPER PET CARRIER AND SIZE LISTED ON THEIR WEBSITE. YOUR DOG WILL BE TRAVELLING ON THE SAME FLIGHT AS YOURSELF</li><li>RESERVE A SPACE FOR THEM UP IN THE CABIN ( MANY AIRLINES WILL ALLOW SMALL DOGS WITH AIRLINE APPROVED BAGS UNDER 8 KGS) TO BE PLACED BETWEEN YOUR LEGS</li><li>BOOK YOUR PETS ON A FLIGHT WITHOUT YOU. THIS IS OFTEN COMMON WHEN THERE ARE MORE PETS THAN THERE ARE PEOPLE TRAVELLING. SOME AIRLINES HAVE A QUOTA OF ONE PET PER PERSON FLYING.</li><li>GET QUOTES AND INFORMATION FROM PET RELOCATION COMPANIES/AGENTS OR OFTEN THE COMPANY YOU USE FOR MOVING WILL ALSO HAVE A PARTNER THAT RELOCATES PETS FOR THEIR CLIENTS. <p><strong>Basic Requirements for Importing Pets to Vietnam</strong></p>



<p><strong>**ALWAYS&nbsp;</strong>consult your airlines to ask what their rules are for shipping a pet from your home country if you are going that route as you have to make sure that you fulfil both rules. &nbsp;You would be surprised that you may have to fulfill the country exiting rules with live pets as well.</p>



<ul class="wp-block-list"><li>MICROCHIP – NOT REQUIRED BUT GENERALLY A DOG THAT HAS ITS’ MICROCHIP IS BEST OWNERSHIP PRACTICE</li><li>RABIES VACCINATION AND CERTIFICATE – ALL PETS MUST HAVE AN ORIGINAL RABIES CERTIFICATE SIGNED BY THE VET AND SHOTS SHOULD BE MORE THAN 30 DAYS AND LESS THAN 1 YEAR</li><li>IMPORT PERMIT (ONLY REQUIRED FOR MORE THAN 2 PETS) USUALLY THIS SHOULD BE OBTAINED 10 DAYS BEFORE YOU LEAVE AND NOT LESS THAN THAT OR MORE THAN THAT</li><li>HEALTH FORM: APHIS FORM 7001 ( STANDARD HEALTH CERTIFICATE) WHICH MUST BE SIGNED AND FILLED OUT BY THE LICENSED VET. <p>Finding a place to live when you move to a new city, especially Hanoi, is no easy feat. Hanoi is a city full of culture, family, ethnicity, entertainment, history, colours and always something gastronomically enticing. &nbsp;It’s important to read about the areas and also the schools near the area to determine where it best suits your needs.</p>



<p><em><strong>Here at Vietnamlodge Housing, we have the opportunity to learn a lot about housing needs for foreigners and newcomers, and we’ve compiled a list of the best areas for you if you’re considering to move here!</strong></em></p>



<p><strong>TAY HO</strong></p>



<p>This area is known as West Lake and also sits north of the city center with a beautiful lake view for those who are living close by. &nbsp;This area was originally a farmland area and has over time become a place for both locals and Foreigners.&nbsp;You will see different levels of wealth in this area but it is one of the most exciting one to be in if you like to be in the “hubbub” of the community and bumping into people you know wherever you go.</p>



<p>There are local, Western, vegetarian and other ethnic food businesses, cafes, spas, hair salons, shopping malls, medical office, gyms,… If you want to, you’d never need to leave the area. Literally everything is within walking distance if you enjoy the adventure. If you have a dog and want to let him/her run in a field, there is also a couple of spots in Tay Ho with large green patches where you can throw a ball or frisbee with your dog.</p>



<p>You will also note there are 2 gated areas in Tay Ho which are Serviced apartments and housing rentals. In addition, many of the Foreign Embassy Officials are housed in this area, as well as the local Government top ranking officials also have their homes along the lake.</p>



<p>The Western-ess of this place makes it one of the best area to live in Hanoi for newcomers, as it’s very friendly and easy for foreigners. Many locals speak fluent English here, and you’ll make a lot of friends, locals and expats alike if you spend sometime outside your home.</p>



<p><strong>BA DINH</strong></p>



<p>Ba Đình is the area where the most historic attractions lie and is the political center of Vietnam.&nbsp; This used to be called the French Quarter, which is why you will notice all the beautiful French influenced buildings in this area. However, this is the place that you would want to live in if you want a more traditional, authentic “Vietnamese” feel.</p>



<p>In this area, you will be able to find serviced apartments/housing complex, regular apartments and houses. This is the best area for you to stay if you’d like to be a bit closer to the action, a bit more local.</p>



<p><strong>HOAN KIEM</strong></p>



<p>The famous Hoan Kiem lake is probably an area that you heard of even before arriving to Hanoi. &nbsp;It is home of the Hoan Kiem lake, the old quarter of 33 streets and also the French Quarter. This is the main center area of the city. There are malls, bars, craft shops, hotels, opera house, social clubs, high end fashion houses .. the list is endless.</p>



<p>You will definitely not miss a thing living in this area. Some of the best street food stalls are located here and also the famous Dong Xuan Market is in the Hoan Kiem area. Again, it is mainly local living that dominates this area. Many embassies and residences are also located in this area. Apartments and houses are available, though you’ll find it pretty expensive to have a decent sized place affordably, as the price of land is quite expensive compared to other areas. Despite that, it is the best place to live for you if you want to bathe in Hanoi old school culture and lifestyle.</p>



<p><strong>CAU GIAY</strong></p>



<p>This is a very busy area located south west of the city and has really evolved over the past 5 years. More of a local area as the university is also located here. &nbsp;It has been known as the “Silicon Valley” of Hanoi. The area is filled with lots of eateries especially Korean cuisine.</p>



<p>There are footpaths and also lakes nearby, you will find some of the best street vendors selling anything from clothing, food, fruits and flowers. Cau Giay is also where Landmark 72 is, offering a amazing view when you get to the top.</p>



<p>Serviced apartments, houses and apartments are offered in this area. &nbsp;I would rate this more local than foreigner area but certainly the International church has a parish here so there are a lot of foreigners and business men who prefer this area.</p>



<p><strong>CIPUTRA</strong></p>



<p>This is an area that is just located North of the City but easy to get to. It is also just at the base of the bridge to the Airport so it is also very convenient. &nbsp;Ciputra is made up mostly of Expats and also local well-to-do Vietnamese citizens. The United Nations International School (UNIS) is located in Ciputra, so if you have children and would like them to be able to ride their bikes, rollerblade or skateboard to school, this is the place for you.</p>



<p>Ciputra offers amenities to those that live within the compound for a one time, monthly or yearly fee.&nbsp; There are Swimming pool, tennis courts, driving range, spas, hair salons, bakeries and restaurants, all located inside this gated community. There are only a few entrances where traffic can come in and they are all well guarded.</p>



<p>An array of accomodations is offered here, houses, villas, apartments and luxury apartments&nbsp;(sizes are bigger and duplex penthouses are available)&nbsp;UNIS also offers gym membership to the community. Also, there are Fall and Winter community courses offered to everyone, even those who do not have children at the school. &nbsp;Most common is the Saturday Soccer league at UNIS</p>



<p>Once you step outside of the gates, you will be able to find a array of local businesses, wet markets, convenience shops and local restaurants. With Vinhomes Riverside, Ciputra is one of the area with the best quality of life. If you have family and kids, Ciputra is one of the premier area for you.</p>



<p><strong>DONG DA</strong></p>



<p>Đống Đa is bordered by Ba Đình to the north, Hoàn Kiếm to the northeast, Hai Bà Trưng to the east, Thanh Xuân to the south, and Cầu Giấy to the west. In this area, you can find yourself in the hubbub of local life, close to the famous Temple of Literature, and also close to many eating places. It is, however, not a “walking area” to live in. If you like to take walks, this is probably not the ideal place for you.</p>



<p><strong>HAI BA TRUNG</strong></p>



<p>Hai Ba Trung is south of the city and is quite a large area. This is mainly locals but many foreigners love to be here because of the action, nightlife and true urban space. The area is mainly houses that are built close to each other or are attached to each other.</p>



<p>Times City (Built 2012), by VinGroup is also located here boasting 4 high-end Apartments which are relatively new. &nbsp;Times City also has an underground shopping center which has many restaurants, bakeries, cinema as well as shops and grocery store. &nbsp;In addition, VinSchool and VinMec hospital, also by VinGroup, are both located in this large complex area.</p>



<p><strong>LONG BIEN – VINHOMES RIVERSIDE</strong></p>



<p>Vinhomes belongs to VinGroup, owned by one of the Vietnamese on Forbes list. &nbsp;You will start to notice once you get around that there are many “VIN-” things. &nbsp;Vincom mall, Vinmart, Vinhomes, VinPearl, Vinmec, Vinschool…. The list goes on.</p>



<p>Vinhomes Riverside was built about 6 years ago on the south east side of the city center. &nbsp;The concept was to build a closed gated community where there is more land available for housing, nature and away from the noise and busyness of the city. &nbsp;The area has most common amenities available to its home residents and also a large mall and restaurant complex and amusement park.</p>



<p>You will find both houses and villas in this area and many if not all the homes have a man made canal in the backyard. This is not quite the place for someone with a limited budget, however, if you want to enjoy one of the best living experience in Hanoi, then you might just get along with Vinhomes Riverside.</p>



<p><strong>Closing</strong></p>



<p>There are also a lot more areas that Hanoi has to offer that we didn’t cover. However, this post should give you a good idea of the main locations in this beautiful city!</p>

<p>On November 25, 2014 the National Assembly of the Socialist Republic of Vietnam adopted the Housing Act 2014. One of the most striking new features of the Housing Act 2014 is the provision of a separate chapter on housing ownership. in Vietnam by foreign organizations or individuals in Vietnam (in other words, foreigners are entitled to buy houses in Vietnam). Under the Housing Act 2014, detailed regulations on foreigners buying houses, conditions of foreigners buying houses and rights of foreigners buying houses in Vietnam. Considering the needs of foreigners in the procedure of owning houses in Vietnam and helping foreigners buy houses in Vietnam conveniently and quickly, saving the law. Package for foreigners buying houses in Vietnam.<br><strong>Objects of foreigners (foreign organizations and individuals) that own houses in Vietnam:</strong><br>• Foreign organizations and individuals investing in building houses under the project in Vietnam in accordance with the Housing Law and related legal documents;<br>• Foreign-invested enterprises, branches, representative offices of foreign enterprises, foreign investment funds and branches of foreign banks operating in Vietnam (hereinafter referred collectively to as water organizations) out);</p>



<p>• Foreign individuals are allowed to enter Vietnam.<br><strong>The form of owning houses of foreigners in Vietnam</strong><br>• Investment in building houses under the project in Vietnam according to the provisions of the Housing Law and relevant laws;<br>• Purchase, hire purchase, donation, inheritance of commercial houses, including apartment and individual housing in investment projects to build houses. (Except for housing projects in the area of ​​national defense and security in accordance with the regulations of the Government of Vietnam).<br><strong>Conditions and rights and obligations of foreigners buying houses in Vietnam</strong></p>



<p>For individuals and organizations investing in the construction of houses under projects in Vietnam when owning houses in Vietnam, the following conditions must be satisfied:<br>• Have an investment certificate<br>• Having houses built under the project in accordance with the housing law<br><strong>For foreign organizations being foreign-invested enterprises, branches and representative offices of foreign enterprises, foreign investment funds and foreign bank branches operating in Vietnam when buying houses In Vietnam, the following conditions must be satisfied:</strong><br>• Having an investment certificate or a paper related to the permission to operate in Vietnam (hereinafter referred to as investment certificate) issued by a competent Vietnamese state agency.<br><strong>For foreigners buying houses in Vietnam:</strong></p>



<p>• They are allowed to enter Vietnam and are not entitled to diplomatic or consular privileges or immunities according to the provisions of law.<br><strong>For foreign organizations being foreign-invested enterprises, branches and representative offices of foreign enterprises, foreign investment funds and foreign banks’ branches operating in Vietnam and individuals Foreigners buying houses in Vietnam are only allowed to own houses when:</strong><br>• Only buy, hire, donate, inherit, and own no more than 30% of the total number of units in an apartment building; If a separate dwelling house consists of villas and adjoining houses, in an area with a population equivalent to a ward-level administrative unit, it can only buy, hire, donate, inherit and own no more than two hundred and fifty houses;<br>• For foreign individuals, they shall be permitted to own houses as agreed upon in contracts of purchase, sale, hire purchase or donation for the inheritance of houses but must not exceed 50 years as from the date they are granted the certificates. received and may be further extended according to the Government’s regulations if so requested; The term of the house ownership must be clearly stated in the certificate;<br>• In cases where a foreign individual marries a Vietnamese citizen or marries a Vietnamese residing overseas, he / she shall be allowed to own a stable and permanent house and have the rights of the owner of the house as citizen. <p>I refer to Clause 4, Article 7 of Decree No. 99/2015 / ND-CP, which stipulates that foreign individuals can sell their purchased houses. <p>I ask, the determination of foreign organizations or individuals doing business in housing or not based on what criteria? In cases where foreigners own houses, they are free to&nbsp;<em><strong>rent houses as Vietnamese</strong></em>&nbsp;and there is no limit on the number of houses each foreign individual owns and leases upon meeting the conditions stated in Clause 2 of Article 161 Housing Act 2014. Do I understand the current regulations as stated above?</p>



<p><em><strong>Reply :</strong></em>  The Ministry of Construction responds to this issue as follows: Under Clause 8, Article 79 of the Government’s Decree No. 99/2015 / ND-CP of October 20, 2015 detailing and guiding the implementation of a number of articles of the Housing Law, organizations and individuals are strictly forbidden. Foreigners buy houses for resale for profit-making purposes.  However, the current law has no specific provisions on how to resell housing for the purpose of trading profit, so the case of foreign individuals have bought and been granted the right certificate. use land and ownership of houses and other assets attached to land if they no longer need to use them, they may resell such houses according to the provisions of Clause 4, Article 7 of Decree No. 99/2015 / ND-CP. .</p>

<p><em><strong>Foreigners owning houses in Vietnam</strong></em>&nbsp;are allowed to rent&nbsp; According to the Housing Law No. 65/2014 / QH13, foreigners who own houses in Vietnam are allowed to rent this house without any restrictions on the number of houses to be leased.&nbsp; However, prior to renting a house, the foreigner must carry out procedures for notification of the lease of the dwelling house to the district-level housing management agency where the house is located as provided for in Clause 2, Article 162 of the Housing Law.</p>



<p><em><strong>Article 30</strong></em>&nbsp;of the Construction Ministry’s Circular No. 19/2016 / TT-BXD of June 30, 2006 guiding the implementation of a number of provisions of the Housing Law and Decree No. 99/2015 / ND-CP. -CP.&nbsp;In terms of the number of dwellings that foreigners own in Vietnam, this is stipulated in Item 2 of Article 161 of the Housing Law. Accordingly, foreign organizations and individuals are entitled to own no more than 30% of the number of apartments in an apartment building; Not to exceed 250 houses (in separate houses including villas and adjacent houses) in an area equivalent to a ward administrative unit.</p>
